GST on Alcohol in India: Why Liquor Is Outside GST and How It Is Actually Taxed

One of the most commonly misunderstood aspects of India's taxation system is the treatment of alcohol under GST. Alcohol for human consumption operates under a completely different taxation framework.

Alcohol for Human Consumption Is Outside the GST Framework: Unlike most goods and services taxed under GST, liquor continues to be taxed separately by state governments through state excise duty, VAT, special additional levies, and licensing fees.

Why Was Alcohol Excluded from GST? Alcohol was excluded primarily because it is a major source of revenue for state governments. Constitutionally, alcohol for human consumption remains outside the GST framework under the current structure.

How Alcohol Is Actually Taxed: Although GST does not apply directly, liquor is heavily taxed through state excise duty, VAT, special additional levies, licensing fees, and import fees. State excise duty forms a substantial portion of the final retail price.

Why Alcohol Prices Differ Across States: Each state independently controls excise duty rates, VAT structure, distribution policies, and licensing systems. The same brand may cost differently across states.

GST on Alcohol Served in Restaurants and Hotels: While the alcohol component itself remains outside GST, food served in restaurants may attract GST, hotel accommodation may attract GST, and service components may attract GST. Restaurants must maintain careful invoice segregation.

Industrial Alcohol Is Different: Industrial alcohol such as ethanol for industrial use or chemical grade alcohol may fall under GST depending on classification and usage.

Input Tax Credit on Alcohol Expenses: ITC may not be available for non-GST outward supplies linked directly to alcohol for human consumption. Hotels and restaurants should maintain careful invoice segregation and expense classification.

Will Alcohol Ever Come Under GST? The possibility has been debated for years. Many states remain resistant because alcohol taxation contributes significant revenue to state budgets.
